Reference against Justice Mazahir: petition against Justice Ijaz

ISLAMABAD: An application has been filed to separate Justice Ijazul Ahsan from the Supreme Judicial Council. The justification for this appeal is that Justice Ijaz filed a complaint against Supreme Court Justice Mazahir Naqvi in the Supreme Judicial Council (SJC).

Advocate Mian Dawood has filed a constitutional petition in the Supreme Court in which the Federal Government and the Secretary Supreme Judicial Council have been made parties. The order sheet of the case of former CCPO Ghulam Mehmood Dogar is also attached with the petition.

It has been argued in the petition that Justice Ijaz should be removed from the council hearing the complaint against Justice Mazahar, and another senior judge should be made a part of the SJC in his place.

It has been said in the petition that the reference of corruption and misconduct against Justice Mazahar is under hearing in the Judicial Council. On the complaint of the questioner, the Judicial Council has issued a second show cause notice to Justice Mazahar.

Justice Ijaz was a part of the bench that heard Ghulam Mahmood Dogar case, therefore legally and in principle no judge hearing the case of Ghulam Mahmood Dogar can be a member of the Judicial Council, the petition argued.

It has been further stated in the petition that Justice Ijazul Ahsan being a member of the SJC is against Article 10A and 9 of the Constitution. Justice Ejaz will not be able to meet the demands of justice in the council and Justice Ejaz’s two-time disagreement with Justice Mazahar’s protest further strengthens the bias, the petition argues.
